Before the Modification Report Consultation can open, the newly-established Privacy Sub Committee needs to discuss the relevant Privacy Controls Framework changes. SECAS expects this modification to be discussed at the May 2024 meeting of the Privacy Sub-Committee.
What is the issue?
Occasionally, SEC Parties may employ a third-party Other User to act on their behalf and obtain Consumption Data from the Energy Consumers they serve. The SEC is currently worded in such a way that third-party Other Users need to obtain Unambiguous Consent from each Energy Consumer before collecting their Consumption Data. This means a large number of Consumers need to be contacted, which is impacting the ability of SEC Parties to employ the Other User.
What is the solution?
This modification seeks to change SEC Section l 'Data Privacy' and amend the definition of 'Appropriate Permission' to allow contracted Other Users who are acting on behalf of Import Suppliers, Export Suppliers, Gas Suppliers, Electricity Distributors and Gas Transporters to obtain Consumption Data without collecting the Unambiguous Consent of the Energy Consumer.
